DRAW TERMS AND CONDITIONS
Please read the terms and conditions carefully.
By subscribing to the Eligible Service and Promotion Campaign, participants warrant and agree to be bound by stc Bahrain B.S.C Closed (referred to as the “Promoter” or “stc”) Terms and Conditions and any Special Terms and Conditions published on http://www.stc.com.bh/ (“Website”) in relation to the draw for the applicable Promotion.
1. GENERAL TERMS
1.1. The draw for the reward (the “Reward” or “Prize”) is exclusive to new and existing stc customers who use any of the services outlined in clause 2.1 (the “Eligible Services”) during the Promotional Period (“Promotion Campaign” or “Promotion”).
1.2. There is no active Promotional Period at this time. (the “Promotional Period”).
1.3. STC reserves the right to extend the Promotional Period further and adds new Eligible Services by amending the current Terms & Conditions after obtaining the Ministry of Industry and Commerce (“MoIC”) approval.
1.4. In case stc decides to extend the Promotional Period, all subscribers registered in the Promotional Period during its original duration will be considered automatically as participants of the extended Promotional Period.
1.5. The participant in the draw agrees to receive SMS communication from STC relating to the Eligible Service(s) and Promotion.
2. PARTICIPATION ELIGIBILITY
2.1. Eligibility to participate in the draw will be based on the following:
2.1.1. STC Play & WIN:
a. Participation is available through the SMS short code (98850) and the Website.
b. For stc subscribers to register for the Eligible Service, they must send an SMS with one of the following subscription opt-in keywords: “ON”, “WIN”, “YES” using the numerical digits 1 to 9 or subscribe through the Website.
c. Upon registration, Eligible Service is free of charge for the first day and for only one time. Users will be awarded chances to enter the raffle/draw to win the Prizes and receive the daily infotainment content message, which can be found on the Website. Subsequently, the charge is 0.125 BHD per day (excluding VAT)
d. All messages sent from short-code 98850 are free of charge, except for the content messages after the expiry of the free trial period mentioned above, which shall cost 0.125 BHD per day.
e. Customer may unsubscribe from the Eligible Service using any of the below methods:
i. Send an SMS with the opt-out keywords to 98850; or
ii. By calling stc’s Call Center on 124.
f. The draw participation cost does not include the charges related to operator services (such as WAP, GPRS, or mobile internet) nor the cost of accessing the website.
g. Use of WAP, GPRS, or mobile Internet shall undergo stc’s pricing policy.
2.2. To be eligible for the Reward, the participant must be at least 18 years old at the time of participation in the draw.
2.3. Employees of stc (or members of their Immediate families) are not eligible to participate in the draws and win any of the Prizes. "Immediate family" means spouse, parent, child, or sibling, whether they live in the same household as the employee or not.
2.4. Participants may only enter the draw once, unless the Terms and Conditions specify otherwise.
2.5. stc reserves the right to disqualify any participant (after MoIC approval) if it has reasonable grounds to believe the participant has breached any provision of the Terms and Conditions.
2.6. By participating in the draw, participants hereby warrant that all information submitted is accurate, current, and complete.
2.7. Each participant in the Eligible Service and the draw must be the legal owner of the SIM card which they are using the Service through. Otherwise, this participant is liable to STC or/or the owner of that SIM card.
3. TERMS OF USE AND CHANGES
3.1. All participants warrant that they have read and fully understand these Terms and Conditions as published on the Website.
3.2. By registering for the Eligible Service and/or registration for the Reward, participants provide their complete acceptance and full understanding of these Terms and Conditions.
3.3. stc reserves the right to cancel or amend these Terms and Conditions at any time upon obtaining MoIC approval. Any changes will be published on the Website.
3.4. In case of a dispute regarding the Terms and Conditions, conduct, results, and all other matters relating to the Reward, the decision of stc shall be final (upon obtaining MoIC approval).
3.5. These Terms and Conditions will remain in full force and effect during the Promotional Period.
4. DRAW AND PRIZES
4.1. The activation of participants’ records for the Promotional Period will start at 00:00:01 hours on the first day of the Promotion Period and end at 23:59:59 hours on the last day of the Promotion Period.
4.2. The draw winner will be determined via the lucky raffle/draw mechanism at stc’s premises with the attendance of MoIC representative(s).
4.3. Participants are eligible to win a weekly or monthly Prize with just one (1) awarded chance during the corresponding period.
4.4. stc shall notify the winners by calling the subscriber number (MSISDN) from which the user participated in the Eligible Service or Promotion Campaign within a reasonable time. The name or initials of the winners may be announced via SMS to all the participants included in the record and on the Website.
4.5. The winner can only win one Prize.
4.6. All Prizes must be taken as offered and are not exchangeable, transferable, and redeemable for cash. In the event that a Prize is unavailable, STC reserves the right to substitute a Prize of equal or greater value after obtaining MoIC approval.
4.7. Prizes unclaimed after a period of 6 months from the date of raffle will be forfeited and will be transferred to the MoIC.
4.8. The Prizes are not transferable to another person.
4.9. The Prizes are not exchangeable for cash or any other reward.
4.10. After MoIC approval, stc reserves the right to change the Prize without any prior intimation or notice to participants and/or winners, as the case may be.
4.11. stc will notify the winners and deliver the Prizes as soon as possible from the announcement date. However, stc shall not be liable for any delay or loss that may occur in the Prize delivery caused by the winner.
4.12. The winner shall provide stc the following supporting documents as soon as being contacted:
4.12.1. CPR or relevant identification document.
4.12.2. SIM card that was used to participate in the Promotion.
4.13. Prizes may be received by a winner’s representative by proxy upon written confirmation from the winner.
4.14. Once the winner provides the above-required documentation, he/she will be certified upon signing a Prize acceptance document.
4.15. All winners will be notified of how to receive their Prizes within a reasonable time from the raffle date.
4.16. All Prizes will be awarded within one hundred and eighty (180) days after the last day of the Promotional Period.
4.17. In case the winning subscriber number (MSISDN) is under a corporate account. The person using such number must present authorization from the corporate owner of the company stipulating the transfer of the Prize and associated rights.
4.18. Prizes will be effectively granted when stc confirms there is no evidence of fraud to get the Prizes granted.
4.19. If the draw is terminated, stc will publish a message about the termination of the draw on the Website.
4.20. Interruption or early termination of the draw shall not release stc from its obligation to hand the awarded Prizes and execute other actions required, except for the cases when termination or interruption of the draw was called by actions or events which are not under stc’s control.
5. PROTECTION OF PERSONAL DATA
5.1. Participants hereby grant stc their acceptance to stc’s privacy policy at (https://www.stc.com.bh/content/privacypolicy) which includes details of how personal data and information will be used by stc and their data protection rights.
5.2. The Participants accept the creation of files by stc of the personal information that they give out. stc will store personal information by making use of security procedures and guaranteeing the best possible security and confidentiality for the participants’ data.
5.3. By participating in the draw, the winners hereby give their explicit consent that stc can use any of their data, including names, surnames, photos and video images, for advertising purposes and free of charge.
6. INTELLECTUAL PROPERTY RIGHTS
The Eligible Service(s), Promotion, Reward and the entire content of the portal site are protected by intellectual property rights that belong exclusively to stc or to stc’s licensors and fall under national or international legislation. The service is made available to participants exclusively for personal (not commercial) use. Any reproduction, copy, or saving in a different mobile device other than the initial device, transfer, publishing, change, distribution, transmission, publication, selling, translation, execution, modification in any way, reporting, release, or any other use of the content in any way or medium without the prior written consent of stc, for commercial or other purposes, is explicitly forbidden.
7. OBLIGATIONS OF PARTICIPANTS
Participants shall refrain from any illegal, unfair or improper use of the content of the Eligible Service/Promotion and will endeavor not to do anything that can cause any damage or malfunction to the Service or affect third parties, or adversely influence or jeopardize the provision of the Promotion or Eligible Services.
8. LIMITATION OF LIABILITY
8.1. stc accepts no responsibility whatsoever for, including without limitation, any error, omission, interruption, defect, delay in operation or transmission, or communications line failure when it is not under its direct control and execution.
8.2. stc reserves the right to, whenever it is deemed necessary, temporarily suspend the Eligible Service/Promotion for operational reasons (e.g. for repairs, planned maintenance or upgrades). stc will endeavor to restore the Eligible Service/Promotion as soon as possible after any temporary suspension period.
8.3. Prizes shall be collected by the winner from a location to be confirmed by stc.
8.4. stc advises participants to use caution and common sense when participating in the Eligible Service/Promotion at all times. stc makes no representations or warranties as to the quality, suitability or merchantability of any goods or services offered as Prizes. To the extent permitted by law, stc is not liable for any loss suffered to person or property by reason of any act or omission, deliberate or negligent, by stc or its employees or agents, in connection with the arrangement for the supply, or the supply, of goods and services by any person to the Prize winner and, where applicable, to any persons accompanying the Prize winner. This clause does not affect any rights a consumer may have, which cannot be excluded under the laws of the Kingdom of Bahrain. To the fullest extent permitted by law, any liability of the stc or its employees or agents for breach of any such rights is limited to the payment of the costs of having the Prize supplied again.
9. DISCLAIMER OF WARRANTIES
9.1. Participants understand and agree that they participate in the respective Eligible Service/Promotion at their own risk and willingness and have not been coerced in any manner to subscribe to the Eligible Service or participate in the respective Promotion.
9.2. stc makes no warranty, implied or express, that any part of the Eligible Service/Promotion will be uninterrupted and error-free.
9.3. Neither stc nor any of its directors, employees, agents, or suppliers shall accept any responsibility for any damage, loss, injury or disappointment suffered by any entrant participating in the Eligible Service/Promotion or as a result of accepting the Prize.
9.4. stc is not responsible for any problems or technical malfunction of any telephone network or lines, online computer systems, servers, or providers, computer equipment, software failure of any email or entry to be received on account of technical problems or traffic congestion on the Internet, telephone lines or at any web site, or any combination thereof, including any injury or damage to entrant's or any other person's computer or mobile telephone related to or resulting from participation or downloading any materials in the Eligible Service/Promotion.
9.5. By subscribing to the Eligible Service and/or participating in the promotion, participants agree that no claim relating to such losses or injuries (including special, indirect, and consequential losses) shall be asserted against stc, its parent companies, affiliates, directors, officers, employees or agents from any losses, damages, rights, claims, and actions of any kind resulting from acceptance or participant of any Prize, including without limitation, personal injuries, death and property damage.
9.6. The Participant acknowledges that the participation in the Eligible Service/ Promotion implies an express acceptance of all terms and conditions provisioned herein and that no complaint or objections shall be entertained regarding these general terms and conditions. Furthermore, any eventual complaints regarding the Service and/or draw shall only be entertained by stc if such complaints are made within a 30 (thirty) days period from the date in which the reason for said complaint has occurred. Any complaints regarding events over the 30 (thirty) days period shall not be answered.
10. FORCE MAJEURE
10.1.“Force Majeure” means any circumstance reasonably beyond stc’s control, including but not limited to war and other hostilities (whether war be declared or not), invasion, the act of foreign enemies, mobilization, failure of the Internet, requisition or embargo; ionizing radiation or contamination by radioactivity from any nuclear fuel or any nuclear waste from the combustion of nuclear fuel, radio-active toxic explosives, or other hazardous properties of any explosive nuclear assembly or nuclear components thereof; rebellion, revolution, insurrection, military or usurped power and civil war; riot, commotion or disorder.
10.2. stc shall not be considered in default or breach of these Terms and Conditions to the extent that performance is prevented by any circumstances of Force Majeure.
10.3. If stc considers that any circumstances of Force Majeure have occurred which may affect performance, it shall promptly notify the participants thereof.
11. GOVERNING LAW
The Laws of the Kingdom of Bahrain will govern these terms and conditions, the Reward and Eligible Services. Any complaints relating to the draw and/or the Reward should be initially presented to stc who shall endeavor to resolve matters amicably. Any disputes that may arise will be subjected to the exclusive jurisdiction of the Courts of the Kingdom of Bahrain.
